1. Agreement & Acceptance
By engaging Marco Island Water Damage Restoration (“Company”, “we”, “us”) for emergency water extraction, structural drying, mold remediation, or related disaster mitigation services, or by using our website (marcoisland-waterdamage.com), you (“Customer”, “Property Owner”, or “Authorized Agent”) agree to be legally bound by these Terms of Service.
2. Emergency Authorization & Property Access
Upon requesting emergency dispatch or executing a Work Authorization Agreement:
- The Customer grants Marco Restoration and its certified technicians unrestricted access to the subject property to perform emergency mitigation, thermal moisture mapping, and water extraction.
- The Customer authorizes the placement, continuous operation, and monitoring of industrial equipment (LGR dehumidifiers, HEPA air scrubbers, axial air movers) required to achieve dry standards under IICRC S500 guidelines.
- The Customer agrees not to power down, unplug, or relocate drying equipment without prior authorization from our lead technician, as interruptions can cause microbial amplification.
3. Scope of Mitigation vs. Reconstruction
Mitigation services (extraction, antimicrobial application, drying, and structural stabilization) are designed to prevent secondary damage. Complete build-back, structural reconstruction, or cosmetic repairs constitute a separate phase of work requiring independent scope approval and estimates.
4. Pricing, Estimates & Insurance Billing
All mitigation and restoration charges are calculated using industry-standard Xactimate® pricing matrices, reflecting fair market labor and equipment rates in Collier County, Florida.
- Direct Insurance Billing: When authorized, we bill your insurance company directly. The Customer remains responsible for any applicable policy deductible, non-covered items, or policy limits.
- Self-Pay & Commercial Accounts: Invoices are due upon receipt or completion of drying phase milestones as outlined in the service contract.
5. Warranties & Standards of Care
We perform all restoration work in accordance with the highest industry standards, specifically the Institute of Inspection, Cleaning and Restoration Certification (IICRC) S500 Standard for Professional Water Damage Restoration and S520 Standard for Mold Remediation. We warrant that all moisture readings and drying logs accurately reflect environmental conditions at the time of testing.
6. Limitation of Liability
To the maximum extent permitted by Florida law, Marco Restoration shall not be liable for pre-existing structural defects, unrevealed historical mold colonies, hidden plumbing failures, or secondary damage resulting from customer-directed early termination of drying equipment.
7. Governing Law & Jurisdiction
These Terms of Service are governed by the laws of the State of Florida. Any legal action, dispute, or proceeding arising under this agreement shall be brought exclusively in the state courts situated in Collier County, Florida.
